Hi Duke, it would be tuff unless you can prove the Army made you smoke :-) although I do remember in boot a common command for a break was "OK smoke if you got them, if you don't low crawl under the building and pick up trash!" That and the fact that we were issued them free and not requested. I do remember where dead people walking sued the big tobacco companies and won big bucks because "they" made them addicted. But unless you recently got out, it would be very difficult. see below:

Other risk factors for COPD are:
Exposure to certain gases or fumes in the workplace
Exposure to heavy amounts of secondhand smoke and pollution
Frequent use of cooking fire without proper ventilation
